Every day in Ontario at least 2 people will be killed, and another 224
injured, as the result of motor vehicle collisions.
Very few people ever read their automobile insurance policies until
they are involved in an accident. Even fewer people have read or
understand the Insurance Act.
If you have been involved in an accident you need to know your
rights.
Following a car accident, there are two potential claims that you may
advance.
The first is the so-called “no-fault” or Accident Benefits claim. As
the name suggests, this claim can be advanced even if you were
completely at fault for the accident.
The other potential claim is your tort claim or what is sometimes
referred to as a "negligence" or "tort" claim. This is a claim against
the person you feel is responsible for the accident and your resulting
injuries.
The two different types of claims are subject to various complicated
regulations. It is recommended that you speak to a lawyer to understand
your rights:
